Leafari Terms of Service

1. Who We Are

Leafari ("Leafari," "we," "our," or "us") offers an educational plant-identification experience that allows users to upload photos of plants, receive AI-generated identifications, and collect virtual badges and rewards. Leafari is operated by LaunchTap LLC, a corporation organized under the laws of the State of New Hampshire, USA.

2. Acceptance of the Terms

By creating an account, downloading the app, or otherwise accessing or using the Services, you: (a) acknowledge that you have read and understood these Terms; (b) represent that you are at least 18 years old or, if you are between 13 and 17, that your parent or legal guardian has reviewed and agreed to these Terms on your behalf; and (c) agree to be bound by these Terms and our Privacy Policy.

3. Eligibility & Parental Consent

1. Children Under 13. Leafari does not knowingly collect personal information from children under 13 without verifiable parental consent. A parent or guardian must create the account and supervise use.
2. Parental Responsibilities. Parents and guardians are fully responsible for the online conduct of their children and for monitoring their use of the Services.

4. Account Registration & Security

You may need to create an account to access certain features. You agree to:

• Provide accurate, current, and complete information.
• Maintain the confidentiality of your login credentials.
• Notify us immediately of any unauthorized use of your account.

We may suspend or terminate your account if we believe you have violated these Terms.

5. User Content & License

"User Content" means any photos, text, data, or other materials you upload or transmit via the Services.

1. Your Ownership. You retain all rights in your User Content.
2. License to Leafari. By submitting User Content you grant Leafari a worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works, display, and distribute your User Content solely for: (i) operating and improving the Services; (ii) developing new features; and (iii) marketing or promotional purposes (in aggregate or de-identified form).
3. Your Responsibilities. You represent that you have all necessary rights to grant this license and that your User Content does not violate any law or third-party right.
4. User Content Moderation. You acknowledge that Leafari has the right, but not the obligation, to monitor, review, or remove any User Content at our sole discretion to enforce these Terms.

6. Prohibited Conduct & Content Policy

You agree not to post, upload, or transmit any User Content or otherwise engage in any conduct that:

1. Violates any applicable law or regulation.
2. Is unlawful, harmful, defamatory, abusive, obscene, harassing, threatening, or hateful.
3. Infringes on any third party's intellectual property rights, including copyright, trademark, or patent.
4. Violates the privacy or publicity rights of others.
5. Is fraudulent, false, misleading, or deceptive.
6. Contains any viruses, malware, or other malicious code.
7. Attempts to reverse engineer, decompile, or otherwise discover the source code of the Services.
8. Uses the Services to identify plants on private property without permission or in any way that encourages trespassing.

To help maintain a safe and respectful community, we have a zero-tolerance policy for objectionable content. We provide a mechanism within the app for users to flag or report content they deem inappropriate. All reports will be reviewed, and we commit to taking action on such reports within 24 hours by removing the objectionable content and, if necessary, ejecting the user who provided it.

7. Educational & Safety Disclaimer

1. Informational Purposes Only. Plant identifications, care tips, and other information provided through the Services are for educational purposes and should not be relied upon for medical, nutritional, or safety decisions.
2. No Professional Advice. Leafari is not a substitute for professional botanical, horticultural, or medical advice. Always consult a qualified expert before touching, ingesting, or otherwise interacting with any plant.
3. Accuracy Not Guaranteed. AI-generated identifications are probabilistic. Leafari does not guarantee their accuracy and disclaims all liability for decisions made based on the identifications.

8. Virtual Items & Rewards

Leafari may offer virtual badges, points, or other rewards ("Virtual Items"). Virtual Items are digital and have no cash value. They are licensed, not sold. Leafari may modify, remove, or terminate Virtual Items at any time without liability.

9. Subscriptions & Payments (if applicable)

If you purchase a subscription or make in-app purchases:

• Billing. You authorize us to charge your chosen payment method. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Taxes. Prices may not include applicable taxes or fees.
• Cancellation. You may cancel at any time, but payments are non-refundable except as required by law or app-store policies.

10. Intellectual Property

All content and materials provided by Leafari (excluding User Content) including text, graphics, logos, and software are the property of Leafari or its licensors and are protected by copyright, trademark, and other laws. Leafari grants you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes.

11. Third-Party Services & Links

The Services may contain links to third-party websites or services ("Third-Party Services"). Leafari is not responsible for Third-Party Services and your use of them is at your own risk.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or Leafari. Upon termination, Sections 5, 7, 10, 13–17, 19 and any other provisions that by their nature should survive will survive.

13. Indemnification

You agree to indemnify, defend, and hold harmless Leafari, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses (including attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your User Content; or (c) your violation of these Terms or any law.

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. LEAFARI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LEAFARI DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAFARI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY OTHER DAMAGES WHATSOEVER, ARISING OUT OF OR RELATING TO: (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY CONTENT OBTAINED FROM THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL LEAFARI'S AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

16. Governing Law & Dispute Resolution

1. Governing Law. These Terms and any disputes arising out of or relating thereto are governed by the laws of the State of New Hampshire, USA, without regard to conflict-of-laws principles.
2. Informal Resolution. Before filing a claim, you agree to contact us to seek an informal resolution.
3. Arbitration. If a dispute is not resolved informally, it shall be finally settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. You and Leafari waive the right to a jury trial.
4. Exception for Injunctive Relief. Either party may seek injunctive relief in any court of competent jurisdiction.

17. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms in the app or by other reasonable means. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.

18. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. These Terms constitute the entire agreement between you and Leafari regarding the Services and supersede all prior agreements.
